Terms of Service

These terms govern your use of Makert. Please read them — by using Makert you agree to them.

1. Who we are

Makert ("Makert", "we", "us") builds and hosts branded online shops for independent local makers (each a "Maker") at their own subdomain of makert.co. A person who places an order through a Maker's shop is a "Buyer". These terms apply to Makers, Buyers and anyone who visits the site.

2. What Makert does — and does not do

Makert provides the software and hosting for a Maker's shop, an order dashboard, and tools to manage products, orders and messages. Makert is not a marketplace, a payment processor, or a party to any order. Every order placed through a shop is a direct transaction between the Buyer and the Maker. Makert does not process, hold or handle payment for orders, and takes no commission on sales.

3. Orders are between Buyer and Maker

The Maker is solely responsible for their products, descriptions, prices, availability, fulfilment, and for collecting payment directly from the Buyer by whatever method they choose. Any questions, changes, refunds, cancellations or disputes about an order are between the Buyer and the Maker. Makert has no liability for the products sold, the conduct of a Maker or Buyer, or the outcome of any order.

4. Maker subscriptions and fees

Makert charges a Maker a one-off setup fee and a recurring monthly subscription fee to build and run their shop (currently $300 setup and $15 per month; current pricing is shown on our site). These fees are billed to the Maker by card through our payment provider, Stripe. Subscriptions renew monthly until cancelled. A Maker may cancel at any time; fees already paid are non-refundable except where required by law. We may change our fees on reasonable notice.

5. Maker responsibilities

As a Maker you are responsible for complying with all laws that apply to your business — including food-safety, labelling, allergen, licensing, consumer-protection and tax obligations. You confirm you have the right to sell what you list and to use the images, names and branding you upload. You must keep your account credentials secure and not use Makert for anything unlawful, deceptive or harmful.

6. Acceptable use

You agree not to misuse Makert: no unlawful, infringing, fraudulent or harmful content; no attempts to breach security, access other tenants' data, scrape at scale, or disrupt the service. We may suspend or remove a shop or account that breaches these terms or puts the platform or its users at risk.

7. Your content

You keep ownership of the content you upload (product details, photos, branding, copy). You grant Makert the licence needed to host and display that content as part of running your shop and the public directory. You can export or remove your content, and we will delete a Maker's data on request or on account closure (see our Privacy Policy).

8. Availability and disclaimers

We work to keep Makert running reliably but do not guarantee uninterrupted or error-free service. Makert is provided "as is", without warranties of any kind to the fullest extent permitted by law.

9. Limitation of liability

To the fullest extent permitted by law, Makert is not liable for any indirect, incidental or consequential losses, or for any loss arising from an order between a Buyer and a Maker. Nothing in these terms limits any liability that cannot be limited by law.

10. Changes to these terms

We may update these terms from time to time. We will post the updated version here and change the "last updated" date. Continued use after a change means you accept the updated terms.
